Candidforum Posted October 9, 2024 Share Posted October 9, 2024 (edited) This varies in different states, though depending on the landlord, there is a number of months a tenant can be late on paying his or her rent before getting evicted. While there is no uniform law, just about every state has enacted a law that details the procedure, step by step, in how landlords can evict a tenant based on non-payment of rent. This may involve a notice to pay or quit, some form of notice, which essentially gives the tenant an opportunity to come up with full payment against the rent due within a particular time frame-usually between 3-14 days-or he must vacate the premises. If the tenant does not comply with the notice, only then can the landlord go to court and file for eviction. It is now that the court would decide based on all valid factors whether or not the eviction would be considered valid.
